Judge Upholds Zeke Elliott's Suspension; Recoure Still Possible

The Dallas Cowboys picked a good week to have a bye.

That means their designated sledgehammer has a few more days to avoid his NFL suspension for being whatever.

His reprieve via court injunction just went the way of the dodo bird when the Federal Court's Fifth Circuit's Court of Appeals ixnay'd it.

The judges said it was a procedural thing. Elliott's attorneys said it wasn't. Guess who won that argument.

So, it's time to do what America does best.

Head to another court.

Odds are it'll be the Southern District of New York, which is on the NFL's home turf, as it were.

That's where The Commish & Crew won their Ballghazi case and was ready to flex there again last December.

Seems like it could be a challenge.

Sorta like the Cowboys' season without Elliott for the next six contests. They're already 2½ games off the NFC East pace now:

After the suspension, the only standings that will likely matter to them will be for the wild cards.

The irony is that Jerry Jones -- he who threatens to bench players at the pleasure of others -- is depending on the NFLPA to help save his season.

They'll be arguing -- and rightly so -- that the main point of the case hasn't even been heard yet. To do so, they'll need to fight through the procedural matters that caused the injunction to be lifted. Specifically, they'll have to show their interpretation of how the CBA addresses matters like this is the correct one.

If all the legal wrangling takes longer than next week, it's possible another injunction could be requested and granted, giving the judges time to reconsider.

The Cowboys can only hope.
